Eugene Volokh has an editorial in the Wall Street Journal today on the Nike case that I blogged about in April. To me it really represents a dilemma for the business world, because in some cases it is hard to prove if a statement is true or false. This case is fascinating, but I fear that whatever the outcome is it will be manipulated by lawyers, activists, or businesses (whoever it ends up favoring) and the court system will eventually have to re-evaluate their decision.
